Charged with Certain Person in New Jersey?

As touched upon above, certain persons not to possess a weapon in essence criminalizes those caught possessing a weapon after they have previously been convicted of certain crimes. The governing statute for certain persons not to possess a weapon is NJSA 2C:39-7a. It is important to note here that it is irrelevant whether or not the previous conviction that subjects the person to this offense occurred within the State of New Jersey or not. The enumerated crimes include the following:

  • Robbery,
  • Aggravated Sexual Assault,
  • Sexual Assault,
  • Bias Intimidation,
  • Endangering the welfare of a child
  • Possession of a Prohibited Weapon,
  • Possession of a weapon for an Unlawful Purpose,

 

 

In order to be convicted of this offense the prosecution must prove beyond a reasonable doubt that the Defendant purchased, owned, possessed or controlled a weapon after previously being convicted of one of aforementioned offenses.

How Much Jail Time for a Certain Persons Offense in NJ?

If the weapon in question was a firearm, then the Defendant will be charged with a second degree felony offense. If convicted, the Defendant would be facing anywhere from five to ten years in a State Prison. To make matters worse, since this offense must be run consecutive to the unlawful possession of a weapon charge, the Defendant is in essence facing anywhere from ten to twenty years in State Prison. However, if the weapon in question was something other than a firearm, for example a knife, brass knuckles or a stun gun, then the Defendant will be facing a fourth degree felony. A fourth degree felony is punishable by up to eighteen months in State Prison.
