Will I go to Jail for a Cocaine Charge in NJ?

So long as the cocaine possessed was under ½ a Defendant will be charged with a third degree felony. That is even if it is a trace amount. With that being said, if the Defendant is caught possessing closer to that ½ ounce marker, they will most likely be charged with the possession of cocaine with the intent to distribute. A third degree felony is punishable by up to five years in a prison, a fine up to $35,000, a felony criminal record and a six month loss of license. However, New Jersey has created several different diversionary programs that certain Defendants may be able to take advantage of. Those programs include the Pretrial Intervention Program and Drug Court. Both programs will help keep a Defendant accepted into it out of jail and possible even without a felony criminal record as well.
