Local Manville Resident Charged with Possession of Drug Paraphernalia

The Montgomery police department has announced that they have arrested and charged a Manville resident with the possession of drug paraphernalia, a long with several traffic violations. Apparently, the charges came to light after a routine traffic stop for an expired inspection decal and inoperable brake lamp. Once the traffic stop was initiated, the officer claimed he detected the odor of marijuana emanating  from inside the vehicle. Based on the recent change in case law, which has eliminated the necessity of a search warrant for a motor vehicle, provided probable cause is established, a search of the Defendant’s vehicle was conducted. Despite the claim of the odor of marijuana, all that was located inside the vehicle was some form of drug paraphernalia that was used to snort CDS. The Defendant was transported to the Montgomery Police Department and processed for the possession of drug paraphernalia, failure to inspect a vehicle and maintenance of lamps. Once the Defendant was processed, he was released upon a summons to appear in the Montgomery Municipal Court.

Since the Defendant referenced above was charged with a disorderly persons offense (drug paraphernalia) and traffic violations, the charges will be litigated in the Montgomery Municipal Court. The Montgomery Municipal Court has jurisdiction over all disorderly persons, petty disorderly persons and traffic offenses that occur within the townships borders. If the Defendant was charged with a more serious offense, like the possession of cocaine, all of the charges would have to be transferred to the Somerset County Superior Court, which is located in Somerville, New Jersey for disposition.
