Hunterdon County NJ MDMA Possession Attorney

All MDMA possession charges will be governed by NJSA 2C:35-10a(1). This is the same subsection of the New Jersey criminal code that covers all other drug offenses. The statute is rather straightforward, it states in pertinent part:

It is unlawful for any person knowingly or purposely, to obtain or to possess, actually or constructively, a controlled dangerous substance.

One of the key areas to look at when defending a possession charge in New Jersey is the underlying search and/or seizure. Depending on the facts surround the search, a Defendant may have had their constitutional rights violated. If that is the case, a suppression motion can be filed and if successful, the charges may ultimately be dismissed outright. Also, another angle to look to exploit could be the underlying possession theory. Meaning, is the prosecution seeking to prove “possession” by trying to establish actual possession, constructive possession or joint possession. Will I go to Jail for Possessing Ecstasy?

All ecstasy, molly and MDMA possession charges are third degree felony offenses in New Jersey. That is regardless of whether it is a trace amount or substantial quantity. With that being said, more often than not, if a Defendant is caught possessing more than a couple grams, they will be charged with possession with intent as opposed to simple possession. A third degree felony drug possession charge will subject a Defendant to a potential five year prison sentence, a fine up to $35,000 and a felony criminal record. With that being said, a Defendant may be eligible for the Pretrial Intervention Program. Charged with Distributing MDMA in Somerville NJ

Whether a Defendant is charged with possessing MDMA with the intent to distribute,  distributing MDMA or manufacturing of MDMA, it will be governed by NJSA 2C:35-5. Although the penalties are the same regardless of the specific conduct alleged, these are basically three different offenses and require the prosecution to prove drastically different facts. Here is breakdown of what the prosecution must prove in order to obtain a conviction for each section.

Possession of MDMA with the Intent to Distribute

The prosecution must establish that the Defendant possessed or had under their control, a specific quantity of MDMA/Molly/Ecstasy and that they had the intent to distribute that MDMA/Molly/Ecstasy.

MDMA Distribution

The prosecution must establish that the Defendant knowingly or purposely distributed a specific quantity of MDMA/Molly/Ecstasy.

MDMA Manufacturing

The prosecution must establish that the Defendant knowingly or purposely manufactured the MDMA/Molly/Ecstasy.

Will I go to Jail for Distributing MDMA in NJ?

As touched upon earlier, MDAM distribution charges can either a first, second or third degree felony offense. The quantity of MDMA seized will dictate what degree a Defendant is actually charged with. Also, the degree will dictate what type of penalties a Defendant will be facing.
